As of January 5, 2018 the Department of Labor has updated their guidelines for determining whether an internship can be unpaid. The new guideline focuses on the Primary Beneficary Test to ensure that the growth of the intern receives primary benefit of the internship experience. It is also critical that interns not displace the hiring of paid employees to perform functions of the business.
